Terms of Service

These Terms of Service (“Terms”) govern your use of services, products, and information provided by Cool Days A/C Inc. (“Cool Days,” “we,” “us,” or “our”), a family-owned HVAC company serving the east valley of Phoenix, Arizona. By requesting services, purchasing products, accepting a proposal, signing an agreement, visiting our website, or otherwise interacting with Cool Days, you agree to be bound by these Terms. If you do not agree, do not use Cool Days services or products.

Services Offered

Cool Days provides sales, installation, repair, maintenance, and replacement of air conditioners, heat pumps, ductwork, and related HVAC equipment and components.

Service availability, pricing, and scheduling are subject to change. Quoted prices and estimates are valid only for the time period stated in the quote.

All work is performed in accordance with applicable federal, state, and local laws and building codes.

Estimates, Proposals, and Contracts

Written estimates or proposals supplied by Cool Days are valid only for the period specified on the document. Verbal estimates are informational only and not binding.

A binding contract is formed when both parties execute a written agreement or when you accept the written estimate/proposal and any required deposits are paid.

Any changes to scope, materials, or schedule must be documented in a written change order and may affect price and completion time.

Payment Terms

Payment terms, deposits, and final payment amounts will be specified in the written estimate, proposal, or contract.

Deposits are non-refundable except as required by law or as otherwise stated in the written agreement.

Final payment is due upon completion of work unless otherwise agreed in writing. Cool Days may require full or partial payment before scheduling or starting work.

Late payments may accrue interest or finance charges as specified in the agreement and may result in suspension of services, collection activity, or lien filing as permitted by law.

Accepted payment methods will be listed at the time of billing.

Warranties and Disclaimers

Cool Days provides manufacturer warranties on new equipment as described in the equipment manufacturer’s documentation. We will facilitate warranty claims but are not responsible for manufacturer warranty denials.

Cool Days provides workmanship warranties as stated in the written contract. Workmanship warranties may be voided by improper use, unauthorized repairs, modifications, or failure to perform required maintenance.

EXCEPT AS EXPRESSLY PROVIDED IN A WRITTEN AGREEMENT, COOL DAYS DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Permits, Inspections, and Code Compliance

Permits and inspections required by local authorities will be obtained and/or coordinated as specified in the contract. Permit fees and inspection costs are typically additional and are your responsibility unless otherwise noted.

Cool Days will perform work in compliance with applicable codes. If a code violation unrelated to our work is discovered, we will notify you and may recommend corrective work at additional cost.

Access to Property and Job Site Conditions

You must provide Cool Days employees and subcontractors safe access to the job site during scheduled work times, including utilities required for work (electricity, gas, water) unless otherwise agreed.

You must disclose known site conditions, structural issues, hazards, or environmental concerns (asbestos, mold, etc.). Cool Days is not responsible for unknown conditions discovered during work; such conditions may require additional work and charges.

Cool Days is not responsible for damage to property or landscaping that is inherently at risk when performing HVAC work, except where caused by our negligence.

Client Responsibilities

Provide accurate project information and decisions necessary for timely completion.

Maintain adequate homeowner’s or property insurance covering materials, equipment, and property during the project.

Secure pets and remove personal items from work areas.

Change Orders and Additional Work

Any additional work or deviations from the original scope will require a written change order signed by both parties. Work performed without a signed change order may still be billed if you approve the work verbally or by conduct.

Additional payment and schedule adjustments related to change orders are due as specified.

Cancellations and Rescheduling

Cancellation and rescheduling policies will be stated in the estimate or contract. Short-notice cancellations or missed appointments may be subject to a fee.

If Cool Days must reschedule due to weather, materials delays, or unforeseen circumstances, we will notify you promptly and coordinate a new appointment.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COOL DAYS’ TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO OUR SERVICES, PRODUCTS, OR THESE TERMS IS LIMITED TO THE AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
